VanLife US, LLC is the owner and operator of www.vanlife.us and all affiliated websites and mobile versions (“VanLife”), a discount club and consumer interest website where you may purchase Packages, Subscriptions, and Merchandise that provide access to Discounts and Benefits. We are the sponsor and promoter of the sweepstakes that we may choose to operate, from time to time, to promote the sale of Packages, Subscriptions, and Merchandise (“Promotion”). During the Promotion, we offer free sweepstakes entries (“Entries”) that provide eligible users who purchase Packages, Subscriptions, and Merchandise or otherwise engage in certain qualifying activities (“AMOE(s)”) with an opportunity to win cash, merchandise, and other things of value (“Prize(s)”), according to these Promo Rules. Entries are not available for purchase, and Entries are non-transferrable. Eligibility to participate in the Promotion and to redeem a Prize is contingent upon fulfilling the requirements set forth in these Promo Rules.

By obtaining Entries, you agree to these Promo Rules and our Terms of Use. These Promo Rules are intended to be read in conjunction with the Terms of Use, and the Terms of Use are incorporated herein by reference. The capitalized words used in these Promo Rules have the same meaning as assigned to those words in the Terms of Use. The Promotion and your participation therein are subject to all applicable federal, state, and local laws and regulations. 

NO PURCHASE OR PAYMENT IS NECESSARY TO PARTICIPATE IN THIS PROMOTION. ALL ENTRIES HAVE AN EQUAL CHANCE OF WINNING A PRIZE. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE THE ODDS OF ANY ENTRY BEING SELECTED AS A WINNER. WE DO NOT OFFER ANY REAL MONEY GAMING. 

We reserve the right to revise these Promo Rules at any time by updating this agreement and the Last Updated date above. Whenever we amend these Promo Rules, we will notify you upon your next visit to VanLife, and you will be required to re-confirm your acceptance prior to participating in the Promotion. If you do not agree to the amended Promo Rules, you are not eligible to participate in the Promotion.

We do not offer, condone, recommend, or encourage illegal gambling. Instead, we offer a sweepstakes to promote the sale of the Packages, Subscriptions, and Merchandise in which we provide you with free opportunities to win Prizes. We may impose a specific set of rules on each particular sweepstakes and you will comply with the rules specific to each particular sweepstakes that you participate in. These sweepstakes do not trigger the prohibitions on gambling in the jurisdictions where we operate. However, we make no guarantee that VanLife is legal in your jurisdiction. You agree to consult with your local authorities or legal advisors before using VanLife, and you will not use VanLife if doing so violates any laws in your jurisdiction. Nothing published on VanLife shall be construed as legal advice. It is your sole and absolute responsibility to comply with all applicable laws. You assume all risks and responsibility for your access to and use of VanLife. We bear no responsibility for your access to or use of VanLife in connection with illegal gambling activities.  

  1. Eligibility

The Promotion is void where prohibited, including in Rhode Island, or any other jurisdiction where use of VanLife is illegal or otherwise prohibited (“Excluded Territory”).

If you are a resident of Georgia, you may participate in any Promotion that does not include cash or any cash equivalent such as cryptocurrency or gift cards as a Prize, if you (i) are a registered user of VanLife, (ii) reside in the United States, (iii) are at least 18 years old and the age of majority in your jurisdiction, (iv) are not on the U.S. Treasury Department’s list of Specially Designated Nationals, and (v) are not an immediate family member of any of our employees, independent contractors, or agents. 

So long as you are not a resident of Georgia nor any Excluded Territory, you may participate in any Promotion if you (i) are a registered user of VanLife, (ii) reside in the United States or Canada, (iii) are at least 18 years old and the age of majority in your jurisdiction, (iv) are not on the U.S. Treasury Department’s list of Specially Designated Nationals, and (v) are not an immediate family member of any of our employees, independent contractors, or agents. 

  1. Promotional Period

Each Promotion begins and ends on the date and time displayed (“Promotional Period”) on the “Upcoming Giveaways” or the “Home Page” section of VanLife. Our servers are the official time-keeping device of each Promotional Period. We reserve the right to begin a new Promotion after any current Promotion ends or is terminated. We further reserve the right to cancel, pause, modify, or suspend any part of or all the Promotion with immediate effect owing to events or circumstances outside of its reasonable control. Any event or circumstance impairing the proper functioning or integrity of the Promotion will be determined by VanLife, and any corrective action (to the extent necessary) will be determined and taken by VanLife in its sole discretion.

  1. Entries

If you are eligible and have agreed to these Promo Rules, we will credit your account with:

  • a specific number of Entries which may vary and is prominently displayed on VanLife if you purchase certain Packages, Subscriptions, and Merchandise.

  • 25 Entries per day if you mail a “Request Card” to PO Box 699, NewYork, NewYork, 10013 on a standard, unfolded, blank, lineless, legibly handwritten 4”x6” post card with the email address associated with your account, the full name shown on your government issued ID, your return residential address associated with your account, and the following statement: “I wish to receive 25 Entries, free of charge, in order to participate in the Promotion offered by VanLife. By submitting this request, I hereby declare that I have read, understood, and agree to be bound by VanLife’s Privacy Policy, Terms of Service and Promo Rules.” If your handwriting is illegible or your Request Card is otherwise noncompliant, as determined in our sole discretion, the Request Card will be void, and the Entries will not be credited to your account. Only 1 Request Card postmarked on the same date will be processed. To be eligible, the postcard must be received by VanLife at least twenty-four (24) hours prior to the end of the Promotional Period to allow for reasonable processing times.

  • 30 Entries for leaving a review – positive or otherwise – per review site, including Google and Facebook (for a total of 60 possible Entries). To be eligible for Entries related to a review, you must send an email to support@vanlife.us including a screenshot of your review, your first and last name, complete address and telephone number, and date of birth. We reserve the right to deduct Entries in the event that you delete a review at a later date.

  • a specific number of Entries for interacting with our accounts on social media, as displayed on our social media accounts from time to time.

We may change the balance of Entries on your account at any time for a good cause, including removing Entries associated with accounts that have been inactive for more than sixty (60) days or in response to violations of these Promo Rules. Entries may also be forfeited if your account is closed for good cause.

If you are a resident of Georgia and attempt to enter any Promotion that includes cash or cash equivalents such as cryptocurrency or gift cards as Prizes, your Entries to that Promotion will be null and void.

  1. Prizes and Odds

We will award the following Prizes by random drawing a winner at the end of the Promotion. Your odds of winning are dependent upon the total number of Entries. 

Prize winners will be notified by private message or email. To redeem Prizes, you must meet the eligibility requirements above, you must pass the verification process below, and your details must match those on your account.

You are responsible for all taxes, fees, charges, and other costs associated with or otherwise incurred as a result of or in relation to the redemption of any Prize, including any shipping and handling fees which are prominently displayed on VanLife. 

Residents of Georgia are not eligible to receive cash or cash equivalents such as cryptocurrency or gift cards as Prizes.

  1. Verification

Before you are entitled to redeem any Prizes, we may require you to sign certain forms, provide certain verification documentation and information, and pass certain KYC/AML procedures to our satisfaction. You are not entitled to any prize, even if the online screen indicates that you are a winner, unless and until your eligibility and the potential winning play has been verified by us, in our sole discretion, and you have provided all necessary forms, documentation, and information within seven (7) days of any request by us. While we may request additional evidence from you, we reserve the right to reject screenshots and other purported evidence of winning in our sole discretion. 

If you fail to provide the requested documentation or information in a timely manner, if you fail to sign the required forms in a timely manner, if you fail to pass our KYC/AML procedures, if we determine that you have violated these Promo Rules, or if we determine that a technical error has occurred, the Prize will be null and void, and, except in the case of technical error outside your control, we may suspend or terminate your account. In the event that you are disqualified for any reason, VanLife may, in its sole discretion, reseed the Prize back into the Promotion. To receive a Prize, you must provide VanLife with valid payout account information along with any requested records confirming your ownership of the account. Payouts of Prizes in cryptocurrency are irreversible in all instances. You release VanLife for any claims arising from payouts to incorrect wallet information.

If you are a resident of Georgia and you win a Prize that is no longer available for any reason, we will provide you with an alternate Prize with a fair market value at least equal to the fair market value of your original Prize. If you are a resident in any other state and you win a Prize that is no longer available for any reason, we will provide you with an option to receive cash or an alternate Prize with a fair market value at least equal to the fair market value of your original Prize. Residents of Georgia are not eligible for alternatives Prizes in the form of cash or cash equivalents such as cryptocurrency or gift cards.

If the Winner is a resident of Canada, in order to claim a Prize, the Winner will be required to correctly answer within the time period defined us, without mechanical or other aid, a mathematical skill-testing question (“Skill-Testing Question”) to be administered through your account on the Site, email, or telephone. If the Skill-Testing Question is not answered correctly by the Winner, we reserve the right to withhold providing the Prize to the Winner and select an alternative Winner of the Prize.

  1. No Cheating or Disruptive Behavior

You will not cheat, including (i) exploiting bugs, (ii) utilizing bots or other fraudulent means to gain an unfair advantage, (iii) failing to comply with the rules specific to any sweepstakes that you participate in, (iv) creating multiple accounts, or (v) otherwise engaging in platform manipulation. You will not tamper with the entry process (such as by using automated means to obtain Entries), tamper with the redemption process, engage in disruptive behavior, or otherwise undermine the operation of the Promotion. Any Entries obtained or Prizes won through such activities, as determined in our sole discretion, will be null and void. If you engage in such activities or otherwise violate these Promo Rules, you will be disqualified from the Promotion, and we may seek damages from you to the fullest extent of the law. Our failure to enforce any provision of these Promo Rules shall not constitute a waiver of that provision.

  1. Publicity

Except where prohibited by law, your participation in the Promotion constitutes your consent to the use of your name, image, likeness, opinions, comments, photograph, voice, geographic data (i.e., hometown, U.S. State of residency or Canadian province of residency ), and winnings details by us or our agents for promotional purposes in any media, worldwide, without further payment, notice, or consideration to you.

  1. Social Media Posts

If you post comments on our social media pages or elsewhere during any Promotion that are considered bullying, spiteful, disparaging, defamatory, or upsetting to VanLife or to any user of VanLife, we may remove, request removal, or demand removal of your comments, and you will be disqualified from the Promotion.

  1. Release, Indemnification, Limitation of Liability

You hereby agree to defend, release, hold harmless, and indemnify us and our parent companies, subsidiaries, affiliated companies, officers, directors, employees, independent contractors, agents, representatives, users, media partners, advertisers, content providers, suppliers, and related parties (“Released Parties”) from and against any and all claims, costs, expenses, liabilities, and damages (including reasonable attorney fees) arising out of or related to your use of VanLife or your participation in the Promotion.

To the extent permitted by law, the Released Parties are not responsible for:

  • Any incorrect or inaccurate information, whether caused by you, coding error, or by any of the equipment or programming associated with or utilized in the Promotion.

  • Technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in computers, phone lines, or network hardware or software.

  • Unauthorized human intervention in any part of the Promotion.

  • Payment of any Prizes to any person who does not, in our sole determination, (i) meet the eligibility requirements, (ii) timely provide the required verification documentation and information, or (iii) pass certain KYC/AML procedures.

  • Any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from your participation in the Promotion or receipt, use, or misuse of any Prize.

If for any reason your Entries have been erroneously deleted, lost, or otherwise destroyed or corrupted due to our fault, your sole remedy is replacement of an equivalent amount of Entries.

Under no circumstances will you be permitted to obtain, and you hereby waive all rights to claim punitive, incidental, or consequential damages, or any other damages or awards, including attorneys' fees, other than your actual out-of-pocket expenses (i.e., costs associated with participating in this Promotion). You further waive all rights to have damages multiplied or increased.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY DESCRIBED ABOVE, SO THEY MAY NOT APPLY TO YOU.

  1. Authorization and Permission to Send Emails to You 

You authorize us to email you notices, advertisements, and other communications. You understand and agree that such communications may contain language about sweepstakes which is not suitable for minors. This authorization will continue until you request us to remove you from our email list. You understand and agree that even unsolicited email correspondence from us, or our affiliates, is not spam as that term is defined under the law.
